BARTHOLETTI LAW APC, dba Law Offices of Victor Bartholetti (“Bartholetti Law,” “we,” “us,” or “our”), respects your privacy and is committed to protecting the personal information of visitors to our website, www.vbartholettilaw.com (the “Site”), and of our clients and prospective clients. This Privacy Policy explains what information we collect, how we use and share it, and the choices and rights available to California residents under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, “CCPA”), and other applicable California law.

This Privacy Policy applies to information collected through the Site. It does not apply to information we collect from clients in the course of an attorney-client relationship, which is separately protected by the attorney-client privilege and our professional and ethical obligations of confidentiality under the California Rules of Professional Conduct.

No attorney-client relationship is created by your use of this Site. You are not considered a client of this firm, and your communications are not protected by attorney-client privilege or confidentiality until a formal attorney-client relationship has been established, which requires a signed engagement agreement. Please do not send confidential or sensitive information through this Site's contact form until we have confirmed representation.

We collect the following categories of personal information, consistent with the categories defined under the CCPA:

• Identifiers — such as your name, email address,  and telephone number, when you submit a contact form, request a consultation, or otherwise communicate with us through the Site.
• Internet or other electronic network activity information — such as your IP address, browser type, device information, pages viewed, and time spent on the Site, collected automatically through cookies and similar technologies. See "Cookies and Tracking Technologies" section below.
• California Customer Records Information / Sensitive Personal Information — if you complete and return our Estate Questionnaire or otherwise provide us with information in connection with an estate planning, probate, trust, or business matter, that information may include your Social Security number, financial account information, real property information, and family or beneficiary information. We collect this information only in the context of an engaged representation, not through the Site itself, and it is protected as confidential client information as described above. Please do not send confidential or sensitive information, including the Estate Questionnaire, through this site.
• Commercial information, such as records of the services you inquire about or retain us to provide.
• We do not knowingly collect personal information from minors under the age of 18 through the Site. 

  We collect personal information:

• Directly from you — for example, when you complete our contact form, request a consultation, or submit information to us by phone, email, or in person.
• Automatically — through cookies and similar tracking technologies when you visit the Site.
• From third parties — such as our e-mail service provider and Google reCAPTCHA, which we use to help prevent spam and abuse of our contact form.

We use the personal information we collect for the following business purposes:

• To respond to your inquiries and requests for consultation;
• To provide legal services to our clients;
• To operate, maintain, and improve the Site;
• To communicate with you, including sending appointment confirmations and administrative updates;
• To detect, prevent, and address security incidents, fraud, or abuse (including through reCAPTCHA);
• To comply with our legal and professional obligations.

We do not sell or share your personal information. “Sell” and “share,” as defined under the CCPA, include disclosing personal information to third parties for monetary or other valuable consideration, or for purposes of cross-context behavioral advertising. Bartholetti Law APC does not engage in either practice, and we do not use tracking technologies for third-party advertising or retargeting purposes. Because we do not sell or share personal information, a “Do Not Sell or Share My Personal Information” link is not applicable to this Site; if that changes, we will update this Policy and add the required opt-out mechanism, including recognition of the Global Privacy Control signal.

We may disclose personal information to the following categories of service providers, solely to help us operate the Site and provide legal services, and only under contracts that restrict their use of your information to the purposes for which we provide it:

• Our website hosting and website-builder provider (GoDaddy);
• Our email and communications providers;
• Google, in connection with reCAPTCHA (see Google's Privacy Policy and Terms of Service);
• Professionals assisting with the administration of our practice (e.g., IT support, cloud storage, accounting), where necessary and under appropriate confidentiality obligations;
• Government authorities or other parties, where required by law, court order, or to protect the rights, property, or safety of Bartholetti Law or others.

We do not disclose personal information to third parties for their own independent marketing purposes.

The Site is built and hosted on GoDaddy's website platform, which uses cookies to enable core website functionality and to provide us with baseline, aggregate traffic analytics as part of its standard hosting service. Beyond GoDaddy's platform-level analytics, we have not installed Google Analytics, advertising pixels (Google, Meta, LinkedIn, or otherwise), or any other third-party analytics or ad-retargeting technology on the Site. You will see a cookie notice when you first visit the Site; you may also control cookies through your browser settings, though disabling cookies may affect the Site's functionality. 

Do Not Track. Some browsers offer a “Do Not Track” signal. Because there is not yet a common industry standard for recognizing such signals, this Site does not currently respond to Do Not Track browser signals. (Note: this Site does honor the Global Privacy Control opt-out preference signal for purposes of any future sale or sharing of personal information, consistent with the "How We Use your Information" section above.)

We retain personal information collected through the Site for as long as reasonably necessary to fulfill the purposes described in this Policy, to comply with our legal, regulatory, and professional obligations (including applicable client-file retention requirements under the California Rules of Professional Conduct), and to resolve disputes.

If you are a California resident, you have the following rights under the CCPA with respect to personal information we collect through the Site:

• Right to Know — the categories and specific pieces of personal information we have collected about you, the sources of that information, and the purposes for collecting it.
• Right to Delete — to request deletion of personal information we have collected from you, subject to certain legal exceptions (for example, information we are required to retain under our professional or legal obligations).
• Right to Correct — to request correction of inaccurate personal information we maintain about you.
• Right to Opt Out of Sale or Sharing — as noted above, we do not sell or share personal information, so there is currently nothing to opt out of.
• Right to Limit Use of Sensitive Personal Information — we do not use sensitive personal information collected through the Site for purposes beyond those necessary to provide the services requested.
• Right to Non-Discrimination — we will not discriminate against you for exercising any of your CCPA rights.

How to submit a request. You, or an authorized agent acting on your behalf, may submit a request by emailing us at info@bartholettilaw.com or calling us at 818-817-9535.

We will need to verify your identity before responding to a request to know, delete, or correct, which may require you to confirm information we already have on file. We will respond within the time periods required by the CCPA (generally 45 days, extendable once by an additional 45 days with notice to you).

 We take reasonable measures to protect personal information submitted through the Site. However, no method of electronic transmission or storage is completely secure.

In particular, information submitted through this Site's contact form is not encrypted in transit. Please do not use the Site's contact form to send sensitive, privileged, or confidential information; if we have not yet confirmed an attorney-client relationship with you, information sent this way is not protected by attorney-client privilege.

Bartholetti Law APC complies with applicable federal and California civil rights laws and does not discriminate on the basis of race, color, national origin, age, disability, or sex.

We may update this Privacy Policy from time to time to reflect changes in our practices or applicable law. The “Effective Date” above reflects the date of the most recent revision. We encourage you to review this Policy periodically.
